By now most of us have heard about Joe Biden declaring that he will pick a black woman for the Supreme Court.

What are the ramifications of Joe Biden declaring he will pick a black woman for the Supreme Court? Don’t we have laws against that according to the EEOC?

The laws enforced by EEOC prohibit an employer or other covered entity (Note: Federal government agencies is one of those “covered entities.) from using neutral employment policies and practices that have a disproportionately negative effect on applicants or employees of a particular race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), or national origin, or on an individual with a disability or class of individuals with disabilities, if the polices or practices at issue are not job-related and necessary to the operation of the business. The laws enforced by EEOC also prohibit an employer from using neutral employment policies and practices that have a disproportionately negative impact on applicants or employees age 40 or older, if the policies or practices at issue are not based on a reasonable factor other than age.

 

Ironically the Supreme Court will soon be hearing a case about that very issue? We conclude that we feel bad for the next Supreme Court Justice. Even if they are worthy they will always have a question hanging over their head. Did I get this job just because of my race and gender?

Joe Biden should stop saying the quiet part out loud! If he would have simply nominated a black woman without telling everyone he intended to only pick a black woman this story would have never blown up. In addition, the black woman nominated, her peers and the public would have looked at it differently. God bless her whoever she is!
